Increasingly organizations have dedicated systems and personnel (recipients) to receive and handle internal whistleblower reports. Yet, the complexity of handling whistleblower reports is often underestimated, and there is a dearth of literature that attempts to describe or analyse the challenges internal recipients face. This paper uses an agency theory inspired lens to provide insight into the complexity of internal whistleblowing, with the aim to identify focal points for improving internal whistleblowing processes. We conceive of internal recipients as agents of two (...) principals in the event of whistleblowing: owner/top management as well as whistleblowers. We identify sources of agency problems and agency costs within these double-agent relationships. We provide avenues for solving these problems and reducing the agency costs. Whistleblowing is the most effective way to unveil wrongdoings. Indeed, whistleblowers often protect their organizations by providing crucial information. While existing research about whistleblowing focuses on the intentions of whistleblowers to report a wrongdoing _after_ a wrongdoing is observed, we seek to understand how individuals view whistleblowing _before_ a wrongdoing is observed. Drawing on self-determination theory our findings of 34 interviews at diverse Canadian nonprofit organizations support our framework and highlight that when a congruence of shared values exists, trust functions (...) as a core belief of the organization, which positively influences an autonomous view of whistleblowing. Based on our findings, we propose a conceptualization of whistleblowing mindset as the root of whistleblowing behaviours that can be influenced by shared or divergent values. We define a whistleblowing mindset as a mental disposition that predetermines individual interpretations and reactions to the witness of a wrongdoing. Our research contributes to the literature by establishing the importance of the whistleblowing mindset in the implementation of whistleblowing programs and providing insights into how shared values can influence the autonomous view in individuals’ whistleblowing mindsets. In view of recent studies that identified certain interest groups as potential whistleblowers, we propose an integrative conceptual framework to examine whistleblower behavior by whistleblower type. The framework, dubbed the whistleblowing triangle, is modeled on the fraud triangle and is comprised of three factors that condition the act of whistleblowing: pressure, opportunity, and rationalization. For a rich examination, we use a qualitative research framework to analyze 11 whistleblowing cases of corporate financial statement fraud in Canada that were publicly denounced between (...) 1995 and 2012. Our analysis indicates that whistleblowers are not only insiders but also outsiders [financial analysts, auditing firms, journalists, politicians, customers, and investors]. It also suggests that a dynamic relation may exist between whistleblowers. In addition, our findings show that most whistleblowers opt for external channels when they fail to receive an adequate response from management, seek media exposure, are interested in financial benefits resulting from the act of whistleblowing, or are interested in protecting their investment. Lastly, we propose categorizing whistleblowers into four conceptual types: protective, skeptical, role-prescribed, and self-interested. (shrink)

This article explores the relationships between legal proof and fundamental epistemic concepts such as knowledge and justification. A survey of the legal literature reveals a confusing array of seemingly inconsistent proposals and presuppositions regarding these relationships. This article makes two contributions. First, it reconciles a number of apparent inconsistencies and tensions in accounts of the epistemology of legal proof. Second, it argues that there is a deeper connection between knowledge and legal proof than is typically argued for or presupposed in (...) the legal literature. This connection is illustrated through a discussion of the Gettier problem in epistemology. It is argued that the gap or disconnect between truth and justification that undermines knowledge in Gettier cases also potentially undermines the success of legal verdicts. (shrink)

ABSTRACT Genomic research and biobanking present several ethical, social and cultural challenges, particularly when conducted in settings with limited scientific research capacity. One of these challenges is determining the model of consent that should support the sharing of human biological samples and data in the context of international collaborative research. In this paper, we report on the views of key research stakeholders in Ghana on what should count as good ethical practice when seeking consent for genomic research and biobanking in (...) Africa. This study was part of a multi-country qualitative case study conducted in three African countries: Ghana, Uganda and Zambia under the auspices of the Human Heredity and Health in Africa initiative (H3Africa). Our study suggests that while participants are willing to give consent for their samples and associated data to be used for future research purposes, they expect to receive feedback about the progress of the research and about the kinds of research being undertaken on their samples and data. These expectations need to be anticipated and discussed during the consent process which should be seen as part of an ongoing communication process throughout the research process. (shrink)

We are frequently confronted with moral situations that are unsettling, confusing, disorienting. We try to come to grips with them. When we do so, we engage in a distinctive type of moral inquiry: hermeneutical inquiry. Its aim is to make sense of our situation. What is it to make sense of one's situation? Hermeneutical inquiry is part of our everyday moral experience. Understanding its nature and its place in moral epistemology is important. Yet, I argue, that existing accounts of moral (...) inquiry do not give us the resources to do so. This paper develops a positive account of hermeneutical inquiry. I argue that when we engage in hermeneutical inquiry, we search for an apt perspective on our situation. (shrink)

ABSTRACTThis article defends the importance of epistemic safety for legal evidence. Drawing on discussions of sensitivity and safety in epistemology, the article explores how similar considerations apply to legal proof. In the legal context, sensitivity concerns whether a factual finding would be made if it were false, and safety concerns how easily a factual finding could be false. The article critiques recent claims about the importance of sensitivity for the law of evidence. In particular, this critique argues that sensitivity does (...) not have much of an effect on the value of legal evidence and that it fails to explain legal doctrine. By contrast, safety affects the quality of legal evidence, and safety better explains central features of the law of evidence, including probative value, admissibility rules, and standards of proof. In recent years, there has been an increase in the establishment of biobanks for genetic and genomic studies around the globe. One example of this is the Human Heredity and Health in Africa Initiative (H3Africa), which has established biobanks in the sub‐region to facilitate future indigenous genomic studies. The concept of ‘broad consent’ has been proposed as a mechanism to enable potential research participants in biobanks to give permission for their samples to be used in future research studies. However, questions (...) remain about the acceptability of this model of consent. Drawing on findings from empirical research about the role of trust in decision‐making, we argue that an account of entrustment may be an appropriate way of addressing current challenges of seeking consent for biobank research in Africa. Vázquez-Arroyo historicizes the ethical turn to better understand its ascendence and reworks Adorno's dialectic of responsibility to reassert the political in contemporary thought and theory. Is it possible that non-natural chemical substances become natural without changing their chemical, physical or physiological characteristics? The history of synthetic flavors with a special emphasis on vanillin suggests that yes, it is possible. This process is called naturalization and means in this case the change of status of a synthetic flavor to something natural. In this article the history of vanillin as a frequently used flavor and its transformation into a natural ingredient in the twentieth century will be presented (...) and analyzed. Studying the particular characteristics of vanillin, it seems that known concepts in the history of science like Ersatzstoff (surrogate) or Wirkstoff (active agent) do not constitute the best fit in describing this flavoring agent. Categorizing vanillin as a Konsumstoff (commodity agent) seems more useful in order to classify its characteristics and its historical development. I suggest using Konsumstoff as a new theoretical and methodological approach to study the history of chemical substances. In this article, the concept of Konsumstoff will be outlined and developed using the vanillin case as a paradigmatic example. (shrink)

Metaphysics is traditionally conceived as aiming at the truth — indeed, the most fundamental truths about the most general features of reality. Philosophical naturalists, urging that philosophical claims be grounded on science, have often assumed an eliminativist attitude towards metaphysics, consequently paying little attention to such a definition. In the more recent literature, however, naturalism has instead been taken to entail that the traditional conception of metaphysics can be accepted if and only if one is a scientific realist (and puts (...) the right constraints on acceptable metaphysical claims). Here, we want to suggest that naturalists can, and perhaps should, pick a third option, based on a significant yet acceptable revision of the established understanding of metaphysics. More particularly, we will claim that a fictionalist approach to metaphysics is compatible with both the idea that the discipline inquires into the fundamental features of reality and naturalistic methodology; at the same time, it meshes well with both scientific realism and instrumentalism. El ideal cosmopolita desarrollado por Kant en su breve escrito La paz perpetua , publicado en 1795, ha gozado de una inmensa influencia y conserva aún hoy una indiscutible vigencia. En su formulación original el ideal kantiano se encontraba íntimamente ligado a la necesidad de encontrar medios adecuados para superar el estado de guerra en el que la historia humana se ha instalado. Tres son las principales propuestas kantianas al respecto: la formación de gobiernos democráticos, la instauración de una federación (...) de Estados libres y la constitución de un derecho cosmopolita. Estas ideas son examinadas a lo largo del presente artículo a la luz de los problemas de las actuales relaciones internacionales, y con especial referencia a dos recientes textos de Rawls y Habermas. Borders delimit the spatial units in which political action takes place. They are not, however, a given object that can be assumed without further reflection. Thus, it is astonishing that until very recently the subject has not been attributed an adequate philosophical status. The border, apart from being a territorial demarcator or a line on the map, is a social construct subject to the political, economic and social conjuncture of each moment in history, and therefore subject to relevant mutations. In (...) the current context of globalization, beyond the question of the extinction of borders or the maintenance of their functions, structural transformations have occurred that alter their material image and their practical scope. It is essential for political philosophy to take note of these changes. Las fronteras delimitan las unidades espaciales en las que se desenvuelve la acción política. No son, sin embargo, un objeto dado que pueda ser asumido sin más reflexión, por lo que resulta insólito que hasta tiempos muy recientes no se le haya otorgado al tema el suficiente rango filosófico. La frontera, además de ser un demarcador territorial o una línea en el mapa, es un constructo social sujeto a la coyuntura política, económica y social de cada momento de la historia, y sujeto, por ende, a relevantes mutaciones. En el actual contexto de la globalización, más allá de la extinción de las fronteras o del mantenimiento de sus funciones, se observan transformaciones estructurales que alteran su imagen material y su alcance práctico. We articulate a distinction between ontology, understood as involving existence questions, and metaphysics, understood as either providing for metaphysical profiles of entities or else as dealing with fundamentality and/or grounding and dependence questions. The distinction, we argue, allows a better understanding of the roles of metaontology and metametaphysics when it comes to discussing the relations between ontology and science on the one hand, and metaphysics and science on the other. We argue that while ontology, as understood in this paper, may (...) have reasonable perspectives for naturalization, given its relation to science, the same cannot be said for metaphysics, given that it is typically understood as an additional theoretical layer over science, not participating in the scientific investigation. That may result either in skepticism over metaphysics, or else on accepting that metaphysics is an autonomous branch of investigation, depending on one’s concern for metaphysics. (shrink)

We discuss some methodological aspects of the relation between physics and metaphysics by dealing specifically with the case of non-relativistic quantum mechanics. Our main claim is that current attempts to productively integrate quantum mechanics and metaphysics are best seen as approaches of what should be called ‘the metaphysics of science’, which is developed by applying already existing metaphysical concepts to scientific theories. We argue that, in this perspective, metaphysics must be understood as an autonomous discipline. It results that this metaphysics (...) cannot hope to derive any kind of justification from science. Thus, one of the main motivations of such project, which is the obtaining of a scientifically respectable justification for the attribution of a single true metaphysical profile to the posits of a scientific theory, is doomed because of the emergence of metaphysical underdetermination from the outset. If metaphysics floats free from physics, which is a premise of such project of integration between these two areas, then it is always possible to attribute more than one metaphysical profile to dress physical entities. What is it to take responsibility for a moral failure? This chapter investigates taking responsibility for wrongdoing. It starts by considering a prominent view in the literature: that to take responsibility for a wrong is to blame oneself for it. Contrary to the self-blame account, it is argued that taking responsibility and self-blame can come apart in various ways. Instead, the normative footprint account is defended. It is suggested that wrongdoing changes the normative landscape in systematic ways: it can create (...) duties to apologize, to acknowledge the wrong done, to make amends, to respond to the wronged party’s upset. To take responsibility for a wrong is to own the normative consequences of one’s wrong. (shrink)

For many decades, access to human biological samples, such as cells, tissues, organs, blood, and sub-cellular materials such as DNA, for use in biomedical research, has been central in understanding the nature and transmission of diseases across the globe. However, the limitations of current ethical and regulatory frameworks in sub-Saharan Africa to govern the collection, export, storage and reuse of these samples have resulted in inconsistencies in practice and a number of ethical concerns for sample donors, researchers and research ethics (...) committees. There are certain standards of legal interpretation. Interpretive directives are heterogeneous—both in terms of the issues they address and of the form. Not all authors consider the canons of interpretation to be norms like any other ones. Moreover, some claim that the term “incorrect interpretation” refers only to an arbitrarily chosen concept. I intend to investigate whether, despite the objections raised, interpretative directives can be said to have the status of legal norms. I wonder whether the so-called law of interpretation (...) (LoI), can provide a normative key to assess the correctness of the interpretation of legal texts. Text raises important questions concerning LoI. Firstly, the question of the status of interpretative directives and the problem of their defeasibility. Second, it refers to the problem of compliance with interpretative directives and the consequences of their violation, drawing attention to the two contexts of legal interpretation (the context of discovery and justification) and to the fact that canons of interpretation can constitute a standard for the correctness of the interpretative procedure and for its result. Third, this paper refers to the problem of vagueness of interpretative directives, analysing the advantages of maintaining it to a certain extent, as well as the possibilities of reducing it in the rest. The fourth issue analysed is the multiplicity of canons and the lack of a defined hierarchy of them. I conclude by pointing out that LoI should provide a model by which to assess the correctness of an interpretation. (shrink)

The article examines the correlation between the world and the word in two novels which engage with a post-apocalyptic scenario: David Markson’s Wittgenstein’s Mistress and Cormac McCarthy’s The Road. Shifting the focus from the very event of catastrophe to the notion of survival through memory and storytelling, both novels problematize the strained relationship between language and reality in an increasingly diminished and dehumanized world. My aim is to investigate the limits of language as well as its capacity to withstand the (...) chaos, loss, trauma, and death that follow the apocalypse. The issues to be considered include the influence of external experience on forms of communication, the role of central metaphors and their relation to the form of both novels, as well as the word’s capacity to preserve human values and hopes. Both novels will be discussed as deconstructionist projects in which language becomes a habitat at once impossible and life-preserving: in Wittgenstein’s Mistress it plays the role of both home and prison, whereas in The Road it functions as messianic discourse which simultaneously carries, propels and extinguishes the human hope for a transcendental reality beyond the post-apocalyptic emptiness and doubt. Este artículo presenta los fonemas segmentales del mapudungun hablado en Icalma y un perfil fonético-fonológico de parte importante del cordón cordillerano de habla pewenche. El marco de referencia utilizado es el descriptivismo norteamericano, cuyas propuestas provienen de Pike y se actualizan en los trabajos de Burquest y Salamanca, Cifuentes y Figueroa. El instrumento utilizado fue una lista léxica de 108 ítems y la cantidad de colaboradores entrevistados fue de nueve. Con respecto a la descripción fonético-fonológica del mapudungun hablado en la (...) zona, destacan los siguientes resultados: a) predominan las realizaciones fricativas áfonas [ f ] y [ θ ]; b) los fonos interdentales [ t̟ ], [ n̟ ] y [ l̟ ], y el fono fricativo velar [ ɣ ], tienen estatus fonémico; y c) el fono [ ʃ ] no ocurre en la zona. Por otra parte, si se compara el mapudungun hablado en Icalma con el de Alto Bío-Bío, Lonquimay y Curarrehue, se aprecia, en general, una mayor afinidad con el mapudungun hablado en esta última zona. La utilización de las nociones de “conservador” y “progresista” en las ciencias sociales (y en la opinión pública) ha llegado a configurar dos ideologías políticas. En este número se tratan, a partir de Kant, diversos sentidos de tales nociones en el contexto actual: la perspectiva de la Economía constitucional de Buchanan, la concepción de la sociedad abierta de Popper, la teoría de la justicia de Rawls y la concepción filosófica de la vida social y política de Ortega y Gasset.

W naszym obrazie świata przyzwyczailiśmy się do tego, że roślinność jest niema. Zestawienie pojęć dźwięku i rośliny przywołuje w pamięci szum drzew, odgłos suchych liści, wysokich traw czy łamiących się gałęzi. Wówczas świat flory pobudzony przez wiatr generuje dźwięki. Okazuje się jednak, że te wyobrażenia będą musiały ulec zmianie, ponieważ źródłem dźwięku może być także wnętrze otaczającej nas natury. Ostatnia dekada badań tej materii ujawniła nie tylko odbieranie i wytwarzanie sygnałów akustycznych, ale również reagowanie na muzykę jako właściwości roślin. Obserwacje (...) wskazują także na wzajemne komunikowanie się badanych obiektów. Audialne fenomeny o roślinnym pochodzeniu stanowią punkt wyjścia do rozważań na temat analizy dźwięków w oparciu o teorie semiotyki. Wobec poszerzającego się spektrum możliwości rejestracji i sposobów wykorzystania dźwięku dokonano próby umiejscowienia niestandardowych źródeł dźwięku w przestrzeni audialnej. Namysłowi towarzyszą pytania o funkcje i znaczenie dźwięku, relacje walorów estetycznych, komunikacyjnych i poznawczych oraz płaszczyzny interpretacji. (shrink)

La enseñanza y evaluación de la escritura son actividades esenciales en cualquier área, máxime en Medicina, que es una disciplina altamente especializada. Sin embargo, los docentes, con formación médica, pero no en didáctica ni evaluación de la escritura, muchas veces carecen de herramientas adecuadas para evaluar los aspectos lingüístico-discursivos de los textos que producen sus estudiantes. El objetivo es proponer un instrumento de evaluación contextualizado que permita valorar la calidad lingüístico-discursiva de textos disciplinares producidos por estudiantes de Medicina. Para ello, (...) se desarrolla un estudio cualitativo mediante un estudio de caso, a fin de generar una rúbrica analítica que permita orientar la enseñanza y evaluación de la escritura en la formación en Medicina. El proceso de creación del instrumento incluyó la revisión de distintos insumos de la carrera mencionada, lo que permitió realizar un levantamiento de las propiedades lingüístico-discursivas que debiesen poseer los textos especializados en cuestión y los aspectos que tendrían que ser evaluados por los docentes disciplinares en dichos textos. El instrumento quedó constituido por 17 dimensiones, agrupadas en cuatro macrodimensiones: situación comunicativa, comunicación del conocimiento especializado en Medicina, estructura global y oracional, normativa. Tras diversos procedimientos de validación, la versión final del instrumento obtuvo un acuerdo considerable para la validez de contenido y uno casi perfecto para la confiabilidad intercodificador. En conclusión, este instrumento permitirá obtener información más precisa respecto del nivel de adquisición de la competencia escritural en la formación de médicos; y, además, definir estrategias de intervención adecuadas a las necesidades de la comunidad disciplinar. La caracterización tradicional del Artículo de Investigación como un texto especializado en el que se comunican los resultados de una investigación con un lenguaje neutro, preciso y económico no da cuenta del hecho de que escribir y publicar un Artículo de Investigación es siempre una acción estratégico–persuasiva. En este trabajo presentamos un modelo empíricamente fundado del Posicionamiento Estratégico del Autor en Artículos de Investigación, modelo que rescata el carácter persuasivo de este género. Esta propuesta ha sido obtenida a partir de (...) una investigación de tipo inductivo- deductivo, en la que analizamos 182 Artículos de Investigación de cinco áreas de la ciencia, escritos entre 2010 y 2014 por autores con distintos niveles de experticia. El modelo fue validado exitosamente en distintas etapas y por diversos expertos disciplinares chilenos y extranjeros. En términos discursivos, el Posicionamiento Estratégico del Autor requiere de al menos de una de las siguientes funciones discursivas generales: valorar positivamente lo propio y negativamente lo ajeno. Estas dos macrofunciones se cristalizan en tres tipos de estrategias, que reflejan tres espacios simbólicos que sustentan la actividad científica: el del conocimiento, el del investigador y el del texto. La noción propuesta tiene la fortaleza de estar empíricamente fundamentada y de tener un alto potencial para la alfabetización científica. (shrink)
