Handling Whistleblowing Reports: The Complexity of the Double Agent.Nadia Smaili, Wim Vandekerckhove & Paulina Arroyo Pardo - 2023 - Journal of Business Ethics 186 (2):279-292.
Increasingly organizations have dedicated systems and personnel (recipients) to receive and handle internal whistleblower reports. Yet, the complexity of handling whistleblower reports is often underestimated, and there is a dearth of literature that attempts to describe or analyse the challenges internal recipients face. This paper uses an agency theory inspired lens to provide insight into the complexity of internal whistleblowing, with the aim to identify focal points for improving internal whistleblowing processes. We conceive of internal recipients as agents of two (...)

Navigating Between Control and Trust: The Whistleblowing Mindset.Paulina Arroyo, Leslie Berger & Nadia Smaili - forthcoming - Journal of Business Ethics:1-17.
Whistleblowing is the most effective way to unveil wrongdoings. Indeed, whistleblowers often protect their organizations by providing crucial information. While existing research about whistleblowing focuses on the intentions of whistleblowers to report a wrongdoing _after_ a wrongdoing is observed, we seek to understand how individuals view whistleblowing _before_ a wrongdoing is observed. Drawing on self-determination theory our findings of 34 interviews at diverse Canadian nonprofit organizations support our framework and highlight that when a congruence of shared values exists, trust functions (...)

Categorization of Whistleblowers Using the Whistleblowing Triangle.Nadia Smaili & Paulina Arroyo - 2019 - Journal of Business Ethics 157 (1):95-117.
In view of recent studies that identified certain interest groups as potential whistleblowers, we propose an integrative conceptual framework to examine whistleblower behavior by whistleblower type. The framework, dubbed the whistleblowing triangle, is modeled on the fraud triangle and is comprised of three factors that condition the act of whistleblowing: pressure, opportunity, and rationalization. For a rich examination, we use a qualitative research framework to analyze 11 whistleblowing cases of corporate financial statement fraud in Canada that were publicly denounced between (...)

    The Gettier problem and legal proof: Michael S. Pardo.Michael S. Pardo - 2010 - Legal Theory 16 (1):37-57.
This article explores the relationships between legal proof and fundamental epistemic concepts such as knowledge and justification. A survey of the legal literature reveals a confusing array of seemingly inconsistent proposals and presuppositions regarding these relationships. This article makes two contributions. First, it reconciles a number of apparent inconsistencies and tensions in accounts of the epistemology of legal proof. Second, it argues that there is a deeper connection between knowledge and legal proof than is typically argued for or presupposed in (...)

  5. Informed consent in genomic research and biobanking: taking feedback of findings seriously.Paulina Tindana, Cornelius Depuur, Jantina de Vries, Janet Seeley & Michael Parker - 2020 - Global Bioethics 31 (1):200-215.
ABSTRACT Genomic research and biobanking present several ethical, social and cultural challenges, particularly when conducted in settings with limited scientific research capacity. One of these challenges is determining the model of consent that should support the sharing of human biological samples and data in the context of international collaborative research. In this paper, we report on the views of key research stakeholders in Ghana on what should count as good ethical practice when seeking consent for genomic research and biobanking in (...)

  6. Making sense of things: Moral inquiry as hermeneutical inquiry.Paulina Sliwa - 2023 - Philosophy and Phenomenological Research 109 (1):117-137.
We are frequently confronted with moral situations that are unsettling, confusing, disorienting. We try to come to grips with them. When we do so, we engage in a distinctive type of moral inquiry: hermeneutical inquiry. Its aim is to make sense of our situation. What is it to make sense of one's situation? Hermeneutical inquiry is part of our everyday moral experience. Understanding its nature and its place in moral epistemology is important. Yet, I argue, that existing accounts of moral (...)

Safety vs. sensitivity: Possible worlds and the law of evidence.Michael S. Pardo - 2018 - Legal Theory 24 (1):50-75.
ABSTRACTThis article defends the importance of epistemic safety for legal evidence. Drawing on discussions of sensitivity and safety in epistemology, the article explores how similar considerations apply to legal proof. In the legal context, sensitivity concerns whether a factual finding would be made if it were false, and safety concerns how easily a factual finding could be false. The article critiques recent claims about the importance of sensitivity for the law of evidence. In particular, this critique argues that sensitivity does (...)

‘It is an entrustment’: Broad consent for genomic research and biobanks in sub‐Saharan Africa.Paulina Tindana, Sassy Molyneux, Susan Bull & Michael Parker - 2019 - Developing World Bioethics 19 (1):9-17.
In recent years, there has been an increase in the establishment of biobanks for genetic and genomic studies around the globe. One example of this is the Human Heredity and Health in Africa Initiative (H3Africa), which has established biobanks in the sub‐region to facilitate future indigenous genomic studies. The concept of ‘broad consent’ has been proposed as a mechanism to enable potential research participants in biobanks to give permission for their samples to be used in future research studies. However, questions (...)

Political Responsibility: Responding to Predicaments of Power.Antonio Vázquez-Arroyo - 2016 - New York: Cambridge University Press.
Scholars in the humanities and social sciences have turned to ethics to theorize politics in what seems to be an increasingly depoliticized age. Yet the move toward ethics has obscured the ongoing value of political responsibility and the vibrant life it represents as an effective response to power. Sounding the alarm for those who care about robust forms of civic engagement, this book fights for a new conception of political responsibility that meets the challenges of today's democratic practice. Antonio Y. (...)

Becoming Natural: The Naturalization of Synthetic Flavors in the Twentieth Century and the Introduction of Konsumstoff.Paulina S. Gennermann - 2023 - Berichte Zur Wissenschaftsgeschichte 46 (4):303-319.
Is it possible that non-natural chemical substances become natural without changing their chemical, physical or physiological characteristics? The history of synthetic flavors with a special emphasis on vanillin suggests that yes, it is possible. This process is called naturalization and means in this case the change of status of a synthetic flavor to something natural. In this article the history of vanillin as a frequently used flavor and its transformation into a natural ingredient in the twentieth century will be presented (...)

  15. The game of metaphysics: towards a fictionalist (meta)metaphysics of science.Raoni Arroyo & Matteo Morganti - forthcoming - Revue de Métaphysique et de Morale.
Metaphysics is traditionally conceived as aiming at the truth — indeed, the most fundamental truths about the most general features of reality. Philosophical naturalists, urging that philosophical claims be grounded on science, have often assumed an eliminativist attitude towards metaphysics, consequently paying little attention to such a definition. In the more recent literature, however, naturalism has instead been taken to entail that the traditional conception of metaphysics can be accepted if and only if one is a scientific realist (and puts (...)

Borders delimit the spatial units in which political action takes place. They are not, however, a given object that can be assumed without further reflection. Thus, it is astonishing that until very recently the subject has not been attributed an adequate philosophical status. The border, apart from being a territorial demarcator or a line on the map, is a social construct subject to the political, economic and social conjuncture of each moment in history, and therefore subject to relevant mutations. In (...)

We articulate a distinction between ontology, understood as involving existence questions, and metaphysics, understood as either providing for metaphysical profiles of entities or else as dealing with fundamentality and/or grounding and dependence questions. The distinction, we argue, allows a better understanding of the roles of metaontology and metametaphysics when it comes to discussing the relations between ontology and science on the one hand, and metaphysics and science on the other. We argue that while ontology, as understood in this paper, may (...)

  35. Floating free from physics: the metaphysics of quantum mechanics.Raoni Wohnrath Arroyo & Jonas Rafael Becker Arenhart - unknown
We discuss some methodological aspects of the relation between physics and metaphysics by dealing specifically with the case of non-relativistic quantum mechanics. Our main claim is that current attempts to productively integrate quantum mechanics and metaphysics are best seen as approaches of what should be called ‘the metaphysics of science’, which is developed by applying already existing metaphysical concepts to scientific theories. We argue that, in this perspective, metaphysics must be understood as an autonomous discipline. It results that this metaphysics (...)

What is it to take responsibility for a moral failure? This chapter investigates taking responsibility for wrongdoing. It starts by considering a prominent view in the literature: that to take responsibility for a wrong is to blame oneself for it. Contrary to the self-blame account, it is argued that taking responsibility and self-blame can come apart in various ways. Instead, the normative footprint account is defended. It is suggested that wrongdoing changes the normative landscape in systematic ways: it can create (...)

For many decades, access to human biological samples, such as cells, tissues, organs, blood, and sub-cellular materials such as DNA, for use in biomedical research, has been central in understanding the nature and transmission of diseases across the globe. However, the limitations of current ethical and regulatory frameworks in sub-Saharan Africa to govern the collection, export, storage and reuse of these samples have resulted in inconsistencies in practice and a number of ethical concerns for sample donors, researchers and research ethics (...)

There are certain standards of legal interpretation. Interpretive directives are heterogeneous—both in terms of the issues they address and of the form. Not all authors consider the canons of interpretation to be norms like any other ones. Moreover, some claim that the term “incorrect interpretation” refers only to an arbitrarily chosen concept. I intend to investigate whether, despite the objections raised, interpretative directives can be said to have the status of legal norms. I wonder whether the so-called law of interpretation (...)

The article examines the correlation between the world and the word in two novels which engage with a post-apocalyptic scenario: David Markson’s Wittgenstein’s Mistress and Cormac McCarthy’s The Road. Shifting the focus from the very event of catastrophe to the notion of survival through memory and storytelling, both novels problematize the strained relationship between language and reality in an increasingly diminished and dehumanized world. My aim is to investigate the limits of language as well as its capacity to withstand the (...)
